A JOINT RESOLUTION proposing a constitutional amendment relating to the recognition of a same-sex marriage or civil union.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Article XVI, Texas Constitution, is amended by adding Section 73 to read as follows:

Sec. 73. Marriage in this state shall consist only of the union of one man and one woman. Legal status for unmarried persons which is identical or substantially similar to marital status shall not be valid or recognized.

SECTION 2. This proposed constitutional amendment shall be submitted to the voters at an election to be held November 1, 2005.
The ballot shall be printed to permit voting for or against the proposition: “The constitutional amendment providing that only a marriage between one man and one woman shall be a marriage in Texas, and that a legal status identical to or similar to marriage for unmarried individuals shall not be valid or recognized.”
